Tesla petitions to sell its all-electric Model S sedan direct to car buyers


Silicon-Valley based Tesla Motors wants you to be able to skip the dealership and buy its EVs direct. That sounds like great news – especially if you’ve ever found yourself haggling over the price of floor-mats – but legal battles in a number of states are trying to stop Tesla from cutting dealers out of the deal.

Many car buyers equate visiting a dealership with a trip to the dentist, except haggling for a car is usually considered a much more painful experience. Tesla Motors wants to eliminate the need for a dealer network and sell its electric-only vehicles, such as the luxurious Model S sedan, direct to customers.

A number of states are attempting to hit the brakes on these ambitions, however. One of the most recent salvos in this escalating battle between auto manufacturer-versus-dealerships is taking place in New York, where the state’s franchise laws are being used to argue Tesla is violating the rights of car dealers. (The latest bills blocking Tesla sales in N.Y. were defeated only days ago.)

The various franchise rules and legal-speak vary widely from state to state. Similar tussles have taken place in Massachusetts, New Hampshire, Virginia, North Carolina, Minnesota and Texas. For the moment, it’s the Lone Star state that gets the prize for the strangest set of legal loopholes when it comes to shopping for a Tesla.

There are Tesla showrooms – the company prefers you call them “galleries” – in Texas, but company reps can’t provide test drives, mention prices, or take orders. It’s like going to a bakery and being allowed to look at the cakes and cookies, then being politely ushered out the door.

Tesla argues that it wants to maintain control of its product, to better present the new technology and promote it fairly and accurately. Elon Musk, Tesla’s outspoken CEO, has been urging people to sign an online petition allowing the company to sell direct. “Please support the White House petition to allow direct sales of cars to consumers in all states,” Musk tweeted on June 28.

As of today, Tesla is only a few thousand signatures away from the 100,000 votes needed by the petition’s deadline of July 5.
